Terms of Service

These Terms of Service (“Terms”) govern your use of the 5k — 5000 English Words app and related services (“5k”, “the app”, “the Service”) provided by LinguaCap (“we”, “us”, “our”). By downloading or using 5k, you agree to these Terms. If you don't agree, please don't use the app.

1. Using 5k

5k is an educational app that helps you learn English vocabulary through flashcards, quizzes and spaced repetition. You may use the app for your personal, non-commercial learning. You must be at least 13 years old (or the minimum age of digital consent in your country) to use 5k.

2. Your account

Some features — such as syncing your progress across devices — require an account, which you create by signing in with Google or Apple. You're responsible for keeping access to your sign-in method secure and for activity that happens under your account. Let us know promptly if you believe your account has been compromised.

3. Premium subscriptions

5k offers an optional paid subscription (“Premium”) that unlocks all 5,000 words, every level and unlimited daily practice. The following terms apply:

• Billing. Premium is sold as an auto-renewing subscription. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• Renewal. Your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing & cancelling. You can manage or cancel your subscription anytime in your App Store or Google Play account settings. Cancelling stops future renewals; access continues until the end of the paid period.
• Prices. Prices are shown in the app before purchase and may vary by region. We may change prices for future periods; any change won't affect a period you've already paid for.
• Refunds. Purchases are handled by Apple and Google, so refunds are subject to their policies. We generally cannot issue refunds directly.

4. Free use and trials

5k can be used for free with a limited set of words and features. If we offer a free trial, any unused portion is forfeited when you purchase a subscription, where applicable. We may change what is included in the free tier over time.

5. Acceptable use

When using 5k, you agree not to:

• copy, scrape, resell, or redistribute the app's content or word database;
• reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
• interfere with, disrupt, or place undue load on our servers or the Service;
• access the Service through unauthorized or automated means; or
• use the app for any unlawful purpose or in violation of these Terms.

6. Content and intellectual property

The app, its design, software, word database, definitions, examples and other content are owned by LinguaCap or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use 5k for your own learning. All rights not expressly granted are reserved.

7. Third-party services

5k relies on third-party services including Apple and Google sign-in, the Apple App Store and Google Play, and our subscription provider. Your use of those services is also subject to their respective terms. We're not responsible for third-party services we don't control.

8. Disclaimer of warranties

5k is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee specific learning outcomes, or that the Service will be uninterrupted, error-free or always available.

9. Limitation of liability

To the maximum extent permitted by law, LinguaCap will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the 12 months before the claim.

10. Termination

You may stop using 5k at any time and delete your account from within the app. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could harm us, other users, or third parties. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

11. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and subject to any mandatory consumer protections in your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the “Last updated” date above and, for material changes, provide notice in the app. Continuing to use 5k after changes take effect means you accept the updated Terms.
